Texas's Preliminary Notice Requirement

Texas has one of the most complex lien notice systems in the US. Subcontractors and suppliers must serve monthly notices by the 15th of each month following unpaid work. Missing even one monthly notice can limit lien rights for that month's work.

Deadline: 2nd month following each month in which labor/materials furnished (subs/suppliers)

Does the Property Type Change Your Deadline?

Texas has different notice and filing deadlines for residential homestead properties vs. commercial properties. Residential homestead rules are stricter. Verify with an attorney for residential homestead jobs.

What Contractors Get Wrong in Texas

1
Missing monthly pre-lien notices โ€” Texas's system requires ongoing notice for each month of unpaid work
2
Confusing residential homestead vs. commercial deadlines
3
Missing the lien filing deadline (15th of 3rd or 4th month depending on claimant type)
